L’étude des représentations du droit constitutionnel à l’écran témoigne à merveille de l’intérêt de l’exploration du droit imaginé. En effet, les films et les séries télévisées donnent à voir, fidèlement ou non, des institutions politiques en action, des pouvoirs exécutif et législatif incarnés, des Constitutions de tous horizons. Ce type d’étude invite encore à s’interroger sur le sens de l’exploration du droit imaginé, sur les façons d’y procéder et sur les objectifs à poursuivre.

Studies looking into how constitutional law is depicted on screen perfectly illustrate the value of exploring imagined law. Films and television series show, accurately or not, political institutions in action, incarnations of executive and legislative power, and very different constitutions. Furthermore, these studies encourage us to reflect on what it means to explore imagined law, on the ways in which to do it, and on the objectives to pursue.

S’interroger sur la présence du droit constitutionnel à l’écran revient à s’interroger sur une forme particulière de représentation de la matière. Cette démarche consistant à associer le droit et la fiction constitue un champ de réflexion de plus en plus exploré. Ainsi l’exploitation des thématiques du droit constitutionnel dans le cadre de la fiction appelle un certain nombre de remarques, qui feront l’objet des contributions exposées ici.

Examining how constitutional law is depicted on screen involves analyzing a particular form of its representation. This approach, linking law and fiction, constitutes a growing field of analysis. The ways in which themes of constitutional law are portrayed in fiction have prompted a number of observations, which are the object of the contributions presented here.

Les films « catastrophe » réalisés au tournant du troisième millénaire, loin du scepticisme actuel laissant penser que la liberté entraverait la gestion des crises, représentent des institutions libérales capables d’affronter et de résoudre des catastrophes menaçant l’humanité. Si la liberté est nécessairement limitée dans ces périodes de crise, elle est aussi un atout indispensable à leur résolution. Encore faut-il, toutefois, que ces démocraties ne soient pas gagnées par le populisme…

Disaster movies made around the turn of the millennium, far from demonstrating the current skepticism that sees freedom as hindering crisis management, portray liberal institutions as capable of confronting and overcoming catastrophes threatening humanity. If freedom is necessarily limited during these periods of crisis, it is also an indispensable asset when it comes to resolving them. However, it remains important that these democracies do not turn to populism…

Bertrand Tavernier est un réalisateur dont l’œuvre peut intéresser le juriste. Son cinéma a toujours été pensé en termes de contextualisation, 261notamment sur le plan juridique et politique. Son film, Le Juge et l’Assassin, en est l’exemple paradigmatique. Il lui permet de porter un regard nouveau sur les institutions étatiques de la IIIe République en repensant la relation des individus au grand chiffre des pouvoirs.

Bertrand Tavernier is a director whose work may be of interest to jurists. Contextualization was always a primary consideration in his cinema, particularly with regard to law and politics. His film Le Juge et l ’ Assassin is the paradigmatic example of this. It allows him to show the state institutions of the Third Republic in a new light by rethinking the relationship between individuals and multiple governmental authorities.

Le cinéma hongkongais rayonne à travers le monde. Hong Kong est également connu pour ses tensions politiques, ces dernières années, avec la République populaire de Chine. Or, le cinéma local s’approprie cette évolution constitutionnelle. Alors que le 7e art permet aux néophytes de comprendre les enjeux constitutionnels de l’ex-colonie britannique, pour les Hongkongais, il leur sert de miroir reflétant leur propre identité. Mais peut-on encore parler d’identité constitutionnelle hongkongaise ?

Hong Kong cinema is popular throughout the world. The territory has also been known, in recent years, for its tense political relationship with the People ’ s Republic of China. Its local cinema has explored these constitutional changes. Whereas the “seventh 262 art” enables neophytes to understand the constitutional issues facing the former British colony, for the people of Hong Kong it serves as a mirror reflecting their own identity. But does Hong Kong still have its own constitutional identity?

Robin Trabut, « L’appréhension de l’État dans l’œuvre de Miyazaki »
Miyazaki dresse un second plan politique toujours cohérent dans sa filmographie. Se pose la question de sa conception de l’État, à travers le spectre de sa présence et la théorie de l’individu qui en découle. L’incarnation et l’impact de l’État dans les récits méritent un éclairage par le prisme du droit constitutionnel. En dénonçant un pouvoir tyrannique et centralisateur, Miyazaki nous fait savourer la liberté à travers des personnages qui s’émancipent pour mieux se construire en autonomie.

Robin Trabut, “Understanding the state in Miyazaki’s œuvre”
Miyazaki ’ s œuvre lays out a coherent political background. Questions about his conception of the state can be answered by examining its spectral presence and the theory of the individual that arises from it. It is helpful to look at the incarnation and impact of the state in his work through the prism of constitutional law. In denouncing tyrannical and centralizing power, Miyazaki lets us taste freedom through characters who emancipate themselves to better construct their lives autonomously.

Star Wars est une fiction cinématographique qui attire le regard du constitutionnaliste. Si le type de régime qu’elle met en scène a déjà été analysé, tel n’est pas forcément le cas de la représentation à l’écran de notions comme la démocratie, l’état d’exception et le droit de résistance. Bien que 263périphériques au droit constitutionnel, ces notions sont néanmoins centrales dans sa compréhension et elles alimentent la réflexion sur les frontières entre droit et théorie philosophico-juridique.

The Star Wars films have attracted the attention of constitutionalists. While the type of regime they depict has already been analyzed, this is not necessarily the case for their representation of notions like democracy, state of emergency, and the right to resist. Although peripheral to constitutional law, these notions are nevertheless central to our understanding of it and stimulate reflection on the boundaries between law and philosophico-legal theory.

Le contentieux constitutionnel apparaît peu sur les grands écrans, malgré quelques films aux États-Unis sur le sujet. En France, cette représentation ne déborde pas du petit écran (Baron Noir) en dépit de l’existence d’un véritable « procès constitutionnel ». La justice, envisagée simplement sous l’angle pénal au cinéma, empêche ainsi de développer une culture constitutionnelle et un imaginaire plus large au profit du citoyen-spectateur en la matière.

Constitutional litigation is rarely shown on the big screen, beyond a few American films on the subject. In France, such representations do not extend beyond the small screen ( Baron Noir ), despite the existence of a veritable “constitutional trial.” The fact that films only look at the criminal aspect of the justice system prevents the development of a constitutional culture and a broader imaginary which would help the citizen-viewer ’ s understanding of it.

Figure politique majeure de l’histoire française contemporaine, le Général de Gaulle est pourtant peu représenté sur les écrans jusqu’aux années 90. Les fictions consacrées directement au Général et à son action politique augmentent dans les années 2000, jusqu’à un biopic sorti en 2020. De Gaulle est donc à la fois absent et présent à l’écran. Dans le premier cas, ce sont les thèmes politiques du gaullisme qui ressortent. Dans le second cas, la vie et l’action du Général sont mises en avant.

A major political figure in contemporary French history, Charles de Gaulle was rarely portrayed on screen prior to the 1990s. An increasing number of audiovisual works focusing directly on the general and his political activity appeared in the 2000s, with a biopic released in 2020. De Gaulle is thus both absent and present on the screen. In the first case, the focus is on the political themes of Gaullism. In the second, the general ’ s life and acts take center stage.

La série The Crown permet de découvrir de manière divertissante les coulisses de l’exercice du pouvoir et le fonctionnement des institutions britanniques. Les épisodes reviennent sur la relation entre Elizabeth II et ses Premiers ministres. Un déroulé spectaculaire des crises politiques internes et internationales permet d’appréhender la fragilité des fondations du régime monarchique. La Reine surmonte les crises par sa capacité d’adaptation, veillant ainsi à ce que la monarchie subsiste.

The television series The Crown offers an entertaining glimpse into Britain ’ s corridors of power and how its institutions work. The episodes look at the relationship between Elizabeth II and her prime ministers. A spectacular sequence of domestic and international political crises allows us to understand the fragility of the monarchy ’ s foundations. The Queen overcomes these crises through her ability to adapt, thereby ensuring the monarchy ’ s survival.

Soldaat van Oranje est un film de Paul Verhoeven (1977). Adaptation des mémoires de guerre d’Erik Hazelhoff Roelfzema, il narre les aventures d’un groupe d’amis de 1939 à 1945. Certains d’entre eux réussissent à rejoindre Londres, d’où la Reine Wilhelmina organise la résistance. La monarchie constitutionnelle y est dépeinte de façon très méliorative, si bien que le film, très populaire, semble avoir participé à sa préservation, malgré les scandales qui l’éclaboussent dans les années 1970.

Pierrick Bruyas, “The defense and portrayal of the Dutch parliamentary monarchy in the film Soldaat van Oranje by Paul Verhoeven”
Soldaat van Oranje is a 1977 film by Paul Verhoeven. Adapted from Erik Hazelhoff Roelfzema ’ s war memoirs, it recounts the adventures of a group of friends from 1939 to 1945. Some of them were able to reach London, from where Queen Wilhelmina was organizing the resistance. Its depiction of the constitutional monarchy is highly positive, to the extent that this extremely popular film seems to have played a role in its preservation, despite the scandals that shook it in the 1970s.

La représentation au cinéma du chef de l’État en chef de guerre varie considérablement entre la France et les États-Unis. À Hollywood, instrument du soft power américain, le Président des États-Unis est le plus souvent représenté comme usant du hard power. Au contraire, dans le cinéma français, le Président de la République, pourtant « chef des armées », est un héros très discret. Cela étant, une américanisation des esprits et une présidentialisation des pouvoirs militaires est perceptible.

Cinematic representations of the head of state as war leader vary considerably between France and the United States. In Hollywood, an instrument of American soft power, the president of the United States is usually depicted as using hard power. In French cinema, by contrast, the French president is a very unobtrusive hero, despite being “head of the armed forces.” Nevertheless, an Americanization of attitudes and a presidentialization of military authority can be noted.

La représentation du Parlement dans les séries oscille entre réalité et fiction. Réalité, les scénaristes s’inspirant d’institutions réelles. Fiction, la réalité étant déformée pour servir l’intrigue. Mythe parfois tant l’image d’Épinal d’un Parlement grenouilleur traverse l’espace et le temps. Les séries n’offrent alors qu’une impression de Parlement : une peinture ressemblante qui accentue certains traits, parfois jusqu’à le caricaturer en institution secondaire, un figurant de la démocratie.

Depictions of Parliament in television series alternate between reality and fiction: reality, in that screenwriters draw inspiration from real institutions; fiction, in the reshaping of reality to serve the storyline. Sometimes they reach the point of myth, such as the clichéd image that runs through space and time of a parliament prone to dishonest schemes. These series therefore only give one impression of parliament: a painting resembling its subject that accentuates certain traits, sometimes going so far as to caricature it as a secondary institution, as playing a minor role in democracy.

Le film britannique In the Loop est une satire dont le protagoniste est le ministre du Développement international, et le sujet le processus institutionnel d’entrée en guerre du Royaume-Uni contre un pays du Moyen-Orient, évoquant celui, réel, contre l’Iraq de Saddam Hussein en 2003. Le choix de In the Loop est de remplacer le prestige communément attaché à la fonction ministérielle par une misère, se comprenant tant eu égard au statut du ministre qu’à l’exercice de la fonction.

Alexis Blouët, “The tribulations of a British minister in the film In the Loop”
The British film In the Loop is a satire whose protagonist is the minister for international development. The plot is centered around the institutional process leading to the United Kingdom entering into a war with a Middle Eastern country, evoking the real war against Saddam Hussein ’ s Iraq in 2003. In the Loop chooses to replace the prestige usually associated with the post of minister with an image of desperation, understandable given the minister ’ s status and the way he performs his ministerial duties.

Drôle de défi que d’enseigner un cours intitulé « droit et imaginaires » avec pour ambition d’interroger les imaginaires du droit et d’explorer le droit dans les fictions de l’imaginaire. Avec l’aide précieuse d’étudiants à l’imagination débordante et à la curiosité aiguisée, ce défi long de vingt-quatre heures révéla la formidable boîte à outils qu’est l’imaginaire pour (re)penser le droit.

Amina Hassani, “Exploring the paths of the imaginary to teach law”
It is an unusual challenge to teach a course entitled “law and imaginaries” whose goal is to examine imaginaries of law and explore its representation in the fictional imaginary. Thanks to the precious help of extremely curious students with limitless imaginations, this challenge, twenty-four hours in length, reveals the imaginary to be an incredibly useful toolbox for (re)thinking law.
