Longtemps, le parricide a été considéré par le droit comme un acte gravissime justifiant une répression extraordinaire. De nos jours, ses singularités juridiques semblent s’être estompées. Sur le plan des représentations, le parricide n’a pourtant rien perdu de sa puissance symbolique. De la mythologie grecque à la science-fiction contemporaine, des textes romains au cinéma de genre, le meurtre du père est toujours mis en scène.

For a long time, the law treated parricide as an extremely serious act that warranted severe punishment. Nowadays, its singular legal status seems to have disappeared. In the way it is portrayed outside the law, however, parricide has lost none of its symbolic power. From Greek mythology to contemporary science fiction, from Roman texts to genre cinema, the murder of the father has always been portrayed.

La peine réservée dans l’Antiquité romaine au parricide surprend par son originalité. Cette procédure punitive n’est pourtant pas sans cohérence et révèle que la justice cherche à établir la faute gravissime imputable au criminel, qui a remis en cause le socle de l’organisation sociale. Il est ainsi expulsé de la cité, à l’image des individus que Rome considère comme monstrueux. En cela, la procédure infligée au parricide semble annoncer la théorie contemporaine du droit pénal de l’ennemi.

284Arnaud Paturet, “Parricide, the monstrous, and the enemy. Being cast ‘outside the law’ in the ancient Roman world”
The penalty reserved for parricide in Roman antiquity is highly unusual. However, this punitive action does not lack meaning as it shows justice seeking to establish the extremity of the offence committed by the criminal, who has challenged the very foundation of social organization. The offender is thus expelled from the city, just like those individuals whom Rome viewed as monstrous. The procedure against parricide seems to herald contemporary understandings of enemy criminal law.

Depuis Tantale, chaque Atride commet l’irréparable. Agamemnon, double infanticide, est tué dans un guet-apens conjugal. Oreste répugne à venger la mort paternelle : sa sœur Électre et l’oracle de Delphes le poussent à agir. Le théâtre d’Eschyle, de Sophocle et d’Euripide rappelle les origines et les conséquences du matricide. Les souffrances d’Oreste, le harcèlement des Érinyes, le procès sur l’Aréopage, invitent les spectateurs à réfléchir à l’importance de la mère dans les violences familiales.

Ever since Tantalus, each of his descendants in the House of Atreus has committed the unforgivable. Agamemnon, who committed infanticide, was killed in a conjugal trap. Orestes was reluctant to avenge the death of his father, but was urged to act by his sister Electra and the Oracle of Delphi. The dramas of Aeschylus, Sophocles, and Euripides retell the origins and consequences of this matricide. Their portrayals of the suffering of Orestes, his persecution by the Erinyes, and the trial that took place on the Areopagus invite the audience to reflect on the importance of the mother in the context of family violence.

La mythologie hindoue ne connaît pas le parricide. En parallèle, le droit indien ne sanctionne pas le meurtre sur ascendants. La relation entre ces deux données, l’une relevant de l’imaginaire collectif hindou, l’autre appartenant au droit positif indien, permet d’apprécier le poids des constructions mythiques sur la structure du droit, mais aussi de montrer de quelle manière le droit permet de trancher certaines hypothèses émises par les anthropologues quant à l’« Œdipe indien ».

Mathilde Kamal-Girard, “Do not kill the father. The absence of parricide in Hindu mythology”
Hindu mythology contains no instances of parricide. At the same time, Indian law does not specifically penalize the murder of one’s forebears. The relationship between these two facts, one pertaining to the Hindu collective imagination, the other belonging to Indian positive law, not only indicates the influence of mythical constructions on the structure of the law, but also shows how the law can help resolve certain hypotheses put forward by anthropologists concerning the “Indian Oedipus.”

Lydie Brunetti, « Le parricide symbolique de la Journée du Guichet. Acte fondateur de la Réforme tridentine des cisterciennes françaises »
Le 25 septembre 1609, Angélique Arnauld refuse l’entrée de son abbaye à ses parents. La relation amour/haine entre l’abbesse et son père remonte à son enfance. Les récits sont ceux de l’abbesse, de ses proches et de personnes extérieures. L’abbesse rompt avec ses racines familiales pour s’épanouir dans sa vocation monastique. Cet acte illustre le conflit moral et juridique entre l’autorité naturelle et celle de l’Église. Port-Royal devient ainsi la première abbaye de cisterciennes réformées.

286Lydie Brunetti, “The symbolic parricide of the ‘Journée du Guichet’ (‘Day of the Grille’), the founding event of the Tridentine Reform of the French Cistercians”
On September 25, 1609, the French abbess Angélique Arnauld refused her parents entry to her abbey. The love/hate relationship between the abbess and her father originated in her childhood. Stories about it relate to the abbess, her relatives, and outsiders. Cutting herself off from her family roots, the abbess then flourished in her monastic vocation. This act illustrates the moral and legal conflict between natural authority and that of the Church. Port-Royal thus became the first abbey of the Reformed Cistercians.

Dans Le Père Goriot, un parricide ? L’affirmation peut surprendre. Elle rend compte pourtant du drame qui se joue dans la Pension Vauquer – celui d’une mise à mort consentie d’un père qui se sacrifie, pour ses filles, au nom de l’argent dominant la société dépeinte par Balzac. Lire Le Père Goriot d’un point de vue psychanalytique permet ainsi de comprendre qu’il y a bien des manières de mettre fin au règne du père.

Josette Rico, “Le Père Goriot. Parricide in the Pension Vauquer?”
Is there a parricide in Le Père Goriot? Such a claim may seem surprising. It does, however, acknowledge the nature of the drama that is enacted in the Pension Vauquer, where Père Goriot dies: this is a consensual killing of a father who sacrifices himself for his daughters in the name of money, the dominating feature of the society depicted by Balzac. Reading Le Père Goriot from a psychoanalytic point of view highlights the fact that there are many ways to end the reign of the father.

Sophie Delbrel, « La Terre, roman du parricide intégral ? Meurtres physiques et symboliques dans la France rurale du xixe siècle »
Avec la publication de La Terre, Émile Zola renoue avec le scandale d’une écriture dite naturaliste brossant un tableau peu enviable de la paysannerie. Si 287le texte a pu choquer, il n’en révèle pas moins certains traits de la personnalité de l’écrivain, attaché à ses racines beauceronnes. Surtout, l’ouvrage traduit une fascination pour la terre nourricière, déesse mythique, et réciproquement du rejet de ce qui peut s’apparenter, de près ou de loin, à sa trahison.

Sophie Delbrel, “Reading La Terre as a novel of parricide. Physical and symbolic killings in rural France in the nineteenth century”
With the publication of La Terre, Émile Zola revived the controversy associated with a form of naturalist writing that painted an unenviable picture of rural farm workers. Although the text shocked its readers, it nonetheless reveals personality traits of the writer, who was attached to his roots in the northern French region of Beauce. Above all, the work expresses a fascination for the nourishing earth, portrayed as a mythical goddess, and rejects whatever is associated with her betrayal.

Star Wars est souvent qualifié de mythologie moderne. Son deuxième film The Empire Strikes Back (1980) a placé le parricide au cœur d’un univers fictionnel qui n’a cessé de s’étendre et de se densifier depuis quatre décennies. La place et le rôle de ce thème ont cependant connu des évolutions notables. Il convient de les mettre en lumière car ces mutations révèlent et contribuent au renouvellement d’une saga apparaissant comme le reflet de la culture populaire de chacune de ses époques.

Star Wars is often referred to as a modern mythology. The second film in the sequence, The Empire Strikes Back (1980), placed parricide at the heart of a fictional universe that has continued to expand and become more complex over four decades. The place and role of this theme have, however, undergone some significant changes. These changes are noteworthy since they reveal and contribute to the development of a saga that reflects the popular culture of each of its eras.

Mais rendre le parricide impensable le fait-il disparaître pour autant ?

Can technology provide legal and social solutions to a father’s fear of dying at the hands of his son? Two films provide an appropriate context for an exploration of this question: 2001: A Space Odyssey and Minority Report. In these two stories, the viewer is immersed in a universe in which it is no longer a legal prohibition that protects the lives of fathers, but the circumstances of reality itself. But does making parricide unthinkable make it disappear?

Au xxe siècle, la presse, la littérature et le cinéma succèdent aux chroniques pour aborder le parricide. Même si la France transpose son droit pénal en Extrême-Orient, la norme confucéenne de la piété filiale reste encore ancrée.

Beyond the legal framework, the crime of parricide occupies a unique place in society. All cases, whether in France or in the Far East, are recounted in historical chronicles that also describe the circumstances in which they were committed. In the twentieth century, it was the turn of the press, literature, and cinema to report on parricide. Even though French criminal law was deployed in the Far East, the Confucian norm of filial piety remains central.

Écrivain à ses heures perdues, il a tiré parti de sa parfaite connaissance du droit pour concevoir des énigmes policières originales. Dans son œuvre en effet, les meurtriers sont animés par un mobile juridique : ils passent à l’acte pour obtenir l’application d’une règle favorable. Chez Cyril Hare, l’intrigue policière trouve son origine dans un point de droit.

Cyril Hare is the pen name of Alfred Alexander Gordon Clark, a lawyer and judge in England in the first half of the twentieth century. A writer in his spare time, he used his impeccable knowledge of the law to create original detective novels. In his work, the murderers all have a legal motive: their actions are dictated by the desire to be seen to be in the right in the eyes of the law. In Cyril Hare’s fiction, the mystery is rooted in a point of law.
