Abstract: This article deals with the consequences of inserting a juridical text in a literary text. As indicated in the 1981 Treatise, Mayotte is a French Island. Interestingly, this treatise has been mentioned in numerous literary productions in the course of the last twenty years. The paper uses Genette’s notion of transtextuality to show some issues that come up with the introduction of this Treatise in Alain Kamal Martial’s play La Rupture de chair and in Abdou Salam Baco’s novel Coupeurs de têtes.
