AB  - The paper shows that Grotius’ initial and major claim is that the primitive community is a positive one which gives any member of the human species an equal right to use natural resources in order to provide for his subsistence. The situation of pressing necessity – which cancels all private rights and causes a return to the initial positive community – illustrates this subordination of the subjective right of property to the general right of access to natural resources.
