  • Abstract: The treaty of Versailles introduced the illegality of wars of aggression into positive law. By focusing on aggression without defining it, the post-war years emphasize the initiative of war, rather than its form. This article elucidates the criminalization of wars of aggression by drawing on authors of the jus gentium, for whom the legal basis of war depends on the affirmation of the incompatibility between aggression and right.
